Avila Reizen B.V.
The following terms and conditions apply to your booking with Avila Reizen B.V. (Dutch Chamber of Commerce nr 51111616, ANVR nr 05155) in addition to the ANVR Travel Terms and Conditions as they read with effect from 1 July 2018. The ANVR Travel Terms and Conditions can be found here.
Article 1. General provision
Any reference to the tour operator in the ANVR Consumer Terms and Conditions refers to Avila Reizen.
Article 2. Deposit and payment
2.1. Upon the conclusion of the agreement, a deposit of 20% of the overall agreed travel fee for the country package must be paid (with a minimum of € 150 per person) plus any payments of insurance premiums and costs included in the travel agreement. If airline tickets are part of the travel package arranged by Avila Reizen, these must be paid in full immediately upon conclusion of the agreement. A different deposit or payment arrangement may apply in exceptional cases (e.g. cruises). Deviating deposit rules apply to group travel and incentives.
2.2. The remainder of the travel fee must be paid no later than six weeks before the day of departure. The traveller will be in default in case of late payment. This may result in cancellation, in which case cancellation costs will be charged to the traveller.
2.3. If the agreement is concluded within 6 weeks before the day of departure, all trip fees must be paid immediately.
2.4. Any traveller who fails to make the payment on time will owe the statutory interest on the due amount. In addition, extra-judicial collection costs (15% of the claimed amount) will be charged.
2.5. Payments must preferably be made to the account of Avila Reizen or paid in cash, if desired. Payment by credit card is also possible.
2.6. Avila Reizen charges an administrative fee of € 35 per agreement.
Article 3. Cancellation by the traveller
3.1 If the agreement is terminated by the traveller, the tour operator will charge the following cancellation costs in addition to any reservation fees:
* in case of cancellation before the 42nd calendar day (excluding) before the day of departure: the deposit;
* in case of cancellation from the 42nd calendar day (excluding) up to the 28th calendar day (excluding) before the day of departure: 35% of the trip fees;
* in case of cancellation from the 28th calendar day (excluding) up to the 21st calendar day (excluding) before the day of departure: 40% of the trip fees;
* in case of cancellation from the 21st calendar day (excluding) up to the 14th calendar day (excluding) before the day of departure: 50% of the trip fees;
* in case of cancellation from the 14th calendar day (excluding) up to the 5th calendar day (excluding) before the day of departure: 75% of the trip fees;
* in case of cancellation from the 7th calendar day (excluding) up to the day of departure: 90% of the trip fees
* in case of cancellation on the day of departure or later: all trip fees.
3.2. If a trip consists of several components to which different cancellation provisions apply, the provisions of the supplier that govern the specific component will apply. A deviating cancellation scheme may apply to cruises, car rental, and special services such as national parks and cultural or sports events, for example. You will be informed before the reservation whether specific cancellation provisions apply to parts of the trip that deviate from the above cancellation costs table.
3.3 For international and domestic air tickets, 100% of the trip fees will be charged as cancellation costs from the moment of reservation. You must inform us in advance if you specifically wish to book airline tickets that can be changed or cancelled.
3.4 Cancellation by a traveller in a group
3.4.1 If a traveller in a group cancels his share in a travel agreement for a joint stay in a hotel, apartment, holiday home or other accommodation, he or she will owe cancellation costs.
3.4.2 If the size of the remaining group is included in the price table for this accommodation, the tour operator will make the remaining traveller(s) a proposal for the new group size for the same period in the same accommodation.
3.4.2 The trip fees for the traveller(s) referred to above will change based on the price table. The normal payment rules of the tour operator will apply to the payment of the changed trip fees.
3.4.3 If the proposed change is not possible or not accepted, the agreement will be cancelled for all travellers, who will owe cancellation costs.
3.4.4 The overall amount of cancellation costs and changed trip fees will not exceed the overall trip fees of the original travellers. Any surplus will be deducted from the new trip fees.
3.5. Cancellations outside office hours will be deemed to have taken place on the next business day.
Article 4. Complaints procedure
4.1. A shortcoming in the implementation of the agreement must be reported to the service provider in question as soon as possible to ensure he can find a suitable solution. If the shortcoming is not resolved and affects the quality of the trip, it must immediately be reported to the local representative or, if he or she is not available, to Avila Reizen. The communication costs will be reimbursed by Avila Reizen unless it is determined that they did not reasonably have to be incurred. The incurred costs must be demonstrated (receipts). If it later becomes clear that the traveller has not complied with this notification requirement and has not given Avila Reizen the opportunity to resolve the shortcoming, his right to compensation may be limited or excluded.
4.2. If a complaint is not resolved in a satisfactory manner, it must be submitted to Avila Reizen in writing within one month after the end of the trip with substantiation. If the complaint does not concern the implementation but rather the conclusion of an agreement, it must be submitted to Avila Reizen within one month of the day on which the traveller learns of the facts on which the complaint is based.
4.3. All disputes between Avila Reizen and the traveller are governed by the laws of the Netherlands.
Article 5. Travel documents
5.1. At the time of departure and during the trip, the traveller must be in possession of the necessary valid documents, such as a passport and any required visas, proof of vaccinations, and an (international) driving licence (in case of self-drive). The traveller must check the accuracy of general information provided by Avila Reizen in this respect with bodies that can provide decisive information. If the traveller is unable to comply with the above and cannot (fully) participate in the trip as a result, he or she will bear the costs and any consequences.
5.2. The traveller must have insurance which at least covers the risk of hospital costs, physician costs, funeral costs, and repatriation costs during the trip.
5.3. Avila Reizen will provide the traveller with the necessary travel documents no later than 10 days before the day of departure, provided that the trip has been paid for in full.
Article 6. Changes by the traveller
The traveller may request changes to the agreement up to 28 days before the day of departure. These changes will be made to the extent they are possible. If the trip fees change, the traveller must pay these changed trip fees with deduction of any amounts already paid. In addition to the actual costs, changes will cost € 25 per reservation per change and any communication costs. Postponement of the departure date or reduction in the number of paying passengers is considered (partial) cancellation and governed by Article 2.
Article 7. Changes by Avila Reizen
Any traveller who exercises his or her right to reject changes or an alternative proposal pursuant to the above paragraphs, must inform Avila Reizen within 3 business days of receipt of the notification of the change. A period of 24 hours (1 business day) will apply from 10 days before the day of departure. In that case, Avila Reizen has the right to terminate the agreement with immediate effect. Under penalty of forfeiture, he must exercise this right within 3 business days of receipt of the notification of the change by the traveller. A period of 24 hours (1 business day) will apply from 10 days before the day of departure. The traveller will in that case be entitled to waiver or refund of the trip fees (or, if part of the trip has already taken place, to a refund of a proportional part thereof) within 2 weeks.
Additional conditions when booking National Geographic Expeditions
Article 8. Booking National Geographic Expeditions – Tours with an Expert
8.1 A deposit is required to book a place on one of the Tours with an Expert:
* € 500 per person for programmes of 9 days or less
* € 750 per person for programmes of 10 up to 15 days
* € 2000 per person for programmes of 16 days or more
8.2 All trip fees must be paid no later than 100 days before departure. Avila Reizen can cancel a reservation if the above conditions are not met. All trip fees must be paid for reservations placed within 100 days before the departure.
8.3 If the agreement is terminated by the traveller, the tour operator will charge the following cancellation costs:
* in case of cancellation up to the 120th calendar day (excluding) before the day of departure: 50% of the deposit;
* in case of cancellation from the 120th calendar day (excluding) up to the 90th calendar day (excluding) before the day of departure: 100% of the deposit;
* in case of cancellation from the 90th calendar day (excluding) up to the 45th calendar day (excluding) before the day of departure: 50% of the trip fees;
* in case of cancellation from the 45th calendar day (excluding) up to the day of departure: all trip fees.
Article 9. Booking National Geographic Expeditions – Private expeditions
9.1 A non-refundable deposit of € 1,000 per person is required to book a private expedition. A non-refundable deposit of € 1,500 per person is required for trips to Chile and Easter Island.
9.2 All trip fees must be paid no later than 100 days before the departure. Avila Reizen can cancel a reservation if the above conditions are not met. All trip fees must be paid for reservations placed within 100 days before the departure.
9.3 If the agreement is terminated by the traveller, the tour operator will charge the following cancellation costs:
* in case of cancellation from the 90th calendar day (excluding) up to the 45th calendar day (excluding) before the day of departure: 50% of the trip fees;
* in case of cancellation from the 45th calendar day (excluding) up to the day of departure: all trip fees.
Article 10. Booking National Geographic Expeditions – Custom expeditions
10.1 A non-refundable deposit of 20% of the trip fees per person is required to book a custom expedition. This amount may be higher if it includes applying for permits or booking domestic air travel.
10.2 All trip fees must be paid no later than 100 days before the departure. Avila Reizen can cancel a reservation if the above conditions are not met. All trip fees must be paid for reservations placed within 100 days before the departure.
10.3 If the agreement is terminated by the traveller, the tour operator will charge the following cancellation costs:
* in case of cancellation from the 90th calendar day (excluding) up to the 45th calendar day (excluding) before the day of departure: 50% of the trip fees;
* in case of cancellation from the 45th calendar day (excluding) up to the day of departure: all trip fees.
